Your security deposit is YOUR money. Your landlord holds your deposit as security to guarantee that you will pay all rent due and leave the apartment in the same condition as it was when you rented it (normal wear and tear excepted). However, the deposit remains your property unless and until the landlord follows the legal procedures to allow the landlord to withhold your security deposit to cover damages for which he or she is legally permitted to collect from your deposit or if you owe rent when you move.

If your tenancy is governed by the Chicago Residential Landlord and Tenant Ordinance ("RLTO"), your landlord must strictly follow very specific procedures before he or she can deduct money from your security deposit for damages to the property. If the property is subject to the RLTO and the landlord deducts money from your security deposit without complying with the RLTO exactly, you may be entitled to damages - including the landlord having to pay your attorney's fees.
