Got a Problem with Your Landlord?
I can help! If your landlord hasn't refunded your security deposit, is failing to make repairs, or is causing you other problems, call me or click here to send me an email and tell me about the situation. The consultation is free.
I'm attorney Joan Fenstermaker and I specialize in helping renters resolve issues with landlords. I have successfully represented numerous tenants in obtaining the return of their security deposits and other landlord problems. There is no charge for an initial consultation to discuss your case. In most cases, you will not have to pay any attorney's fees from your own pocket.
Your security deposit is YOUR money. Your landlord holds your deposit as security to guarantee that you will pay all rent due and leave the apartment in the same condition as it was when you rented it (normal wear and tear excepted). However, the deposit remains your property unless and until the landlord follows the legal procedures to allow the landlord to withhold your security deposit to cover damages for which he or she is legally permitted to collect from your deposit or if you owe rent when you move.
If your tenancy is governed by the Chicago Residential Landlord and Tenant Ordinance ("RLTO"), your landlord must strictly follow very specific procedures before he or she can deduct money from your security deposit for damages to the property. If the property is subject to the RLTO and the landlord deducts money from your security deposit without complying with the RLTO exactly, you may be entitled to damages - including the landlord having to pay your attorney's fees.
So contact me for a no-cost consultation. When you call, you will speak with me, not an assistant.
